Never say never, but I doubt it. For all the hum they get on here, CN is more or less a rational actor like any other stakeholder. They are more heavy handed than most, but they have the right to be so. If they are satisfied (ie., see themselves mostly absolved of legal risks), they have no need to press further.

On another note, with CN being so protective of yard ops here, one would think a noise easement or similar would do given the long-established urban context. Not to mention UT’s rumours and city desires to acquire the Grimsby Sub and move this yard in particular— this whole debacle doesn’t lend to either very much, but I digress. I don’t think the book is shut on these ideas.
