Until the building registers, the purchasers do not own the units to sell them. Cresford still owns the units and the residents are paying a phantom mortgage or an occupancy fee to stay there. Currently residents cannot sell unless they have permission from Cresford to assign their unit...

Regarding the pool, the Developer (Cresford in this case) is responsible to establish the common element budget for the first year and pay for any overruns that may occur. This is why the sales office can only guarantee that the pool will be heated for the first year. For year two and beyond...
