    Who said this project is dead. They literally just asked for an extension to obtain their permit.

    Of course your agent will tell you to extend. If you don’t then he does not get paid. This literally comes down to whether you want to take the risk with the permit. This project could literally take another 4 years before they get their permit for all we know

    I believe that they thought they would obtain a permit which is why they continued to sell. I do not understand why you would think it was in bad faith. The developer would have no reason to procrastinate this project because each day they keep losing money and time.

    I believe they did act in good faith. They had no idea that it would be this difficult to get this permit, otherwise they would have cancelled the project already.

    I feel the developer is very well protected due to the contract agreement. I also don’t think the project is dead yet. They will hopefully make a decision by the end of the year. I doubt that the developer enjoys wasting time if there was no potential.
