Appealed to the Ontario Land Tribunal. The 3 day hearing will be July 3 - 5.
The lawyer for Homestead was pushing the OLT to push the appellant for an earlier date in light of the housing crisis in Ottawa. The OLT guidelines had suggested it would be a May/June time frame and that was what the appellant's expert witnesses required to prepare their report so he was unable to meet the April dates suggested by Homestead; he would be ready for May/June but Homestead wasn't available then. The appellant pointed out that Homestead and City would not sit down with him as first requested in Dec. 2022.
The OLT rep asked if there was a chance it could be negotiated and the appellant said yes, if he could have answers to his questions as to why the planning guidelines could not be followed to allow more light and privacy for the residents of the existing tower and the proposed tower. The City and Homestead said that was not possible. So a summer hearing it will be.
(The appellant wants to 'see their work' as to why the site plan MUST remain exactly as drawn and cannot be changed. This is what he's been asking for since December 2022. At October's planning meeting, the appellant pointed out that had they been willing to sit down with him before then, or if they were willing for the rezoning for height and cubic footage to be passed but not the site plan, the OLT could be avoided.
