The top two levels facing east have a balcony. The rest don't. Does that mean that a neighbouring building cannot abut those last two stories? Sorry I don't know a lot about construction or building codes.

Generally speaking that would be true but we have seen that common sense rule broken a few times where a neighboring building has come in later and been a few meters away with another balcony. Those two balconies on the east side are always technically at risk.
 
The height requirements depend on the size of the property that you are building on. If you look at the next door property to the east its very narrow. I bet they wouldn't go higher than 8 stories. Unless they were able to buy the house next store as well, then those balconies could be problematic.
 
^ I really like how this building is shaping up, definitely my favourite addition to that street!
