Yes, 'interesting" case. They first applied for more than 21 floors but were 'talked down' by the City. Then, after 21 were approved and after they had dug the foundations, they tried to get an increase in floors at the Committee of Adjustment where they were told the request was NOT minor so they went to OMB. This is exactly the kind of decision that the OMB should not be able to make (and which the recent reforms will stop). One can argue that the site COULD 'support' 24 floors (or more) but the City's thoughtful decision was it should be capped at 21. It was not wrong to impose this height limit nor against any zoning or planning principles; the OMB should have respected the City decision.
