So the OMB has actually approved the development and allowed the appeal—in part—by agreeing with Parallax that 29 storeys is appropriate for the site… however, as you said, the OMB is requiring a greater east tower setback of 12.5m (as opposed to the proposed 5.5m) from the centreline of the public lane, plus the increased setback of the south podium wall from the property line.Issue wasn't the height but the setbacks. Board ordered that 12.5m is needed from the centreline of the east laneway and an unspecified 'larger' setback to the south. Also, oddly, there was no OPA 231-style office replacement requirement.
Similar to Grid, the applicant has 6 months to submit a revised proposal which follows these stipulations. It'll be interesting to see how they respond.
