At the very least, there would have been a verbal agreement, implying a verbal contract.

I think you'd still have to sue to get the money back, and you wouldn't have much of a case unless you could prove nondelivery of services. There is no mechanism to just take money away from a contractor - nor should there ever be.

It the point of that Iceberg and I understand there a lot of writers doing some real digging.

The digging is going to find some real nice stuff and long over due.
